LOSS OR DAMAGE

Notwithstanding any of these Terms, we do not intend to exclude or limit our liability to you where it would be unlawful to do so. We do not exclude or limit liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

If defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

 

REFUND POLICY

Should you decide to purchase a coaching programme or any personalised product from this Site then you will enter into a contract of sale with us at the point of sale. If you change your mind about purchasing you are entitled to a refund for the 14 days following the purchase. Should your coaching course or programme start within that 14 day period and you decide to cancel then you will be refunded, but the amount of any coaching sessions or value received will be deducted from your refund. Deductions will be calculated on a pro-rata basis.

If you make an electronic purchase then you will be sent a link for a direct download.  At the point of purchase, you will be asked to confirm your express consent to receiving the download immediately. In agreeing to receive the download at the point of purchase you will lose your right to cancel and your right to a refund.

Refunds will not be given for any downloadable resources so please ensure it meets your needs before completing the purchase, for example by viewing free downloads or the associated YouTube videos first. It is advised that you submit any questions regarding the resource or otherwise via the contact form to submit your question.  You must have permission from the bill payer and by ticking the terms and conditions you are confirming that you do.

It is the customers responsibility to ensure they cancel their subscription to memberships before payments are taken if they no longer want access to The Biology Study Club, and no refunds are given for this reason. 

I reserve the right to change product pricing at any time without notice.

TUTORING AND ONLINE LESSONS

By signing up for tuition, webinars, masterclasses, bootcamps, online courses and the membership you agree to the following terms and conditions.

Any student/s under the age of 18 requesting a tuition service must have parental or a legal guardian’s permission to do so.

A student must not request that I complete coursework, essays, or other assignments for them.

You may cancel a 1:1 tuition session up to 12 hours prior to the lesson and receive a full refund.  Beyond this time no refunds will be made unless at the discretion of Miss Estruch Biology LTD. All tuition lessons must be booked with a minimum of 24 hours notice.

Miss Estruch is not responsible for any grade received by a student or any consequence that examination grades entail.

Bullying will not be tolerated in group tuition sessions and will lead to the immediate removal of a student from the session with no refund.

If a Pick n Mix session does not meet the minimum number of 8 students needed for the course to run then the course will be cancelled, and a full refund provided.

If Miss Estruch is unable to attend a tuition session due to unforeseen circumstances the session will be rescheduled. 

 

DELIVERY OF RESOURCES

It is your responsibility to check that your device and internet connection are sufficient for you to download and open the resources successfully.

Resource files may be delivered as zipped files – these may require the use of a laptop or desktop computer to unzip to access the individual files within. 

All products saved as PDFs are not to be edited and the file format is not to be changed.
